Terms & Conditions
These Terms and Conditions form a client agreement between you the client (hereby referred as you, your) and Nurture and Nourish Lactation, ABN 45 749 938 560 (also referred to as Ashleigh Foy, IBCLC, RN, Midwife, the lactation consultant, the midwife, Ash, we).
These Terms and Conditions also include the Fee Schedule, which can be found here. You must read the Fee Schedule along with these terms and conditions.
In making a booking with Nurture and Nourish Lactation you are accepting these Terms and Conditions and Fee Schedule.
Description of Service
These Terms and Conditions relate to services provided by Nurture and Nourish Lactation which include; antenatal and postnatal breastfeeding, chest feeding and lactation support and management, antenatal and postnatal education and support e.g. birthing debriefs, optimal positioning via in person consultations, Telehealth, courses, education programs and written and video media.
Bookings
All clients with bookings will receive an appointment reminder 24 hours before their appointment time, which must be confirmed by completing their Client History and Consent Form delivered by email. If the consultation booked is an in-home consultation then a seperate form In-Home Risk Assessment must also be completed and returned.
In cases where confirmation has not been received, Nurture and Nourish Lactation will reasonably endeavour to contact you to confirm your appointment and obtain pre-appointment documentation.
By booking your appointment you are accepting Nurture and Nourish Lactation Services cancellation and ‘no show’ policy and Fee Schedule as outlined in these Terms and Conditions.
Fee Schedule and Payment
Please read the Fee Schedule here before booking confirmation.
You accept the Fee Schedule as it pertains to the relevant packages and services you have booked.
Partial payment is taken at the time of booking with the remaining balance due at the time of service. All bookings incur a non-refundable deposit of 50%.
Payment for services can be made via bank transfer, banking details are provided on request or on the invoice emailed at the conclusion of consultation or debit or credit card via third party payment system Stripe.
Travel Charges
All appointments booked will incur a travel charge, as set out below.
Distance is determined by radius from Tamworth NSW.

20-35Km -$15
35-50Km -$25
50+ Km -$ 40 + $1/km
Deposits
A non-refundable deposit of 50% of the consult fee is taken on booking your appointment. The deposit can be made via bank transfer or use of debit or credit card via third party payment system Stripe as outlined above. Under no circumstances will the deposit be refunded if the appointment is cancelled by you.
If booking online 50% of the consult fee will be taken at time of booking. This will include the 50% non-refundable deposit. Please see the Cancellation Policy for procedures should your appointment be rescheduled by you, the client or Nurture and Nourish Lactation.
Cancellation policy (cancellation/late cancellation and ‘no show’)
48 hours notice is required to cancel or reschedule your appointment and not incur additional costs beyond the non-refundable deposit.
If you cancel your booking within these 48 hours, but no less than 24 hours and do not attempt to reschedule your appointment within 48 hours from your original appointment time, 50% of your appointment fee will be charged.
If you cancel within 24 hours of your appointment time and do not attempt to reschedule your appointment within 48 hours of your original appointment, 100% of the appointment fee will be charged.
New appointment times are subject to availability.
If your appointment is cancelled by Nurture and Nourish Lactation within 48 hours of your appointment time, no financial penalty will be incurred by you.
If in the event your appointment is cancelled by Nurture and Nourish Lactation and no suitable replacement appointment can be arranged in a reasonable time frame, your full deposit will be refunded.
No Show
A “No Show” occurs in the event that Nurture and Nourish Lactation or one of their representatives, arrives at the designated appointment address at the appointment time and you are not there within 15 minutes of the appointment commencing.
In the event of a ‘no show’ all reasonable attempts will be made by Nurture and Nourish Lactation to contact you and make an alternative appointment.
If an alternative appointment is not made within 48 hours of the appointment time, 100% of the appointment fee plus travel costs as outlined in these Terms and Conditions will be invoiced to you and payable within 7 days via direct debit or third party system.
Delivery of Services (eg business hours, ongoing support)
Nurture and Nourish Lactation's business hours are varied and change to accommodate her family although, generally operates Fridays between 9 am - 3 pm. Correspondence, phone calls and support outside of these hours are at the discretion of the Lactation Consultant.
All packages outlined in the Fee Schedule include 1 week of ongoing email support.
Ongoing support outside this length of time can be purchased under a Subsequent Consultation for an additional cost. Fees for add-ons are not refundable, including where you fail to utilise purchased add-on options fully within the time period stipulated.
Products
Certain products may have limited quantities. Every effort has been made to display accurately, the colour and items listed in our store. We do not guarantee that your computer monitor’s display of any colour to be accurate. We reserve the right to limit the sales of our products and to any person, geographic reason or jurisdiction. All descriptions of products are subject to change at any time without notice, at our discretion.
Digital Products: In accordance with Australian Consumer Law, refunds are only available where the product/service is faulty. Refunds are not available due to change of mind or an expectation of the product that was not in line with the description. All digital products come with detailed descriptions with inclusions, topic outlines, supporting documents if relevant and the expected outcome for the consumer. If you are unsure if a product is fit for your needs it is the consumers responsibility to contact Nurture and Nourish Lactation for clarification. If purchase is made without clarifying or following clarification with the expectation outside of the response given, refunds will not be provided.
Return Product Policy: Our policy is valid for 28 days. If 28 days have surpassed since your purchase, we are unable to provide you with a refund or exchange on any physical item. All eligible returns must be unused, in the same condition that you received it, and in the original packaging. Some items listed in the Nurture and Nourish Lactation store cannot be returned due to hygiene reasons if you have changed your mind. Gift certificates and online E-Guides are non-refundable. You must return the item with proof of purchase, within 28 days and in the condition listed above to be eligible for a refund. Nurture and Nourish Lactation is not responsible for any return postage costs incurred to the individual. We don’t guarantee that we will receive your returned item so tracking is advisable. If a product has signs of use, been opened, not in original packaging, is damaged, or returned later than 28 days from purchase a refund will not be given. You will be notified by email the outcome of your refund whether approved or rejected. If you are approved, then your refund will be processed and a credit will automatically be applies to your credit card or original payment method within a certain amount of days. Refunds are not available for sale items. Items will only be replaced if they are defective or damaged. Contact hello@nurtureandnourishlactation.com.au if you require an exchange.
Shipping Policy: Nurture and Nourish Lactation will try to maintain accurate stock counts on our website. If a stock discrepancy occurs, we will contact you about whether you would prefer to await restocking or if you would prefer a refund. Shipping is calculated after checkout. Payment for shipping will be collected after the purchase via invoice. This price will be the final price for shipping cost to the customer. Items will be posted within 3-5 business days of an order being placed. We do not hold responsibility for transit times as this varies greatly depending on the courier selected and your geographical region. Express postage is the method of shipping you choose, it does not mean that orders are prioritised and expedited by us sooner than others. We will ship the item to the address listed. This can be changed up until the point of dispatch. If tracking is included, the tracking link will be sent to you so you are able to follow the progress of your shipment based on the latest updates made available by the courier. International shipments are not currently available on orders. Contact customer service for an inquiry. GST has been applied to items listed on our website. For parcels damaged in transit, a refund or replacement will be provided as soon as the courier has completed their investigation into the claim. From time to time parcels may be lost in transit. We will process a refund or replacement as soon as the courier has conducted and investigation and deemed the parcel lost.
Dispute Resolution Process
Nurture and Nourish Lactation are committed to their clients and their customer satisfaction. If in the event you are unhappy with the Services provided by Nurture and Nourish Lactation we encourage you to contact us at hello@nurtureandnourishlactation.com.au to discuss your complaint and rectify it if appropriate.

Limitation of Liability
To the extent permitted by law, I Nurture and Nourish Lactation, Ashleigh Foy will not be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the service or any products procured using the Service, or for any other claim related in any way to your use of the Service or any product, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the service or any content (or product) posted, transmitted, or otherwise made available via the service, even if advised of their possibility.
Indemnification
You agree to indemnify, defend and hold harmless Nurture and Nourish Lactation, Ashleigh Foy from any claim or demand, including reasonable legal fees, made by any third party due to, or arising out of, your breach of these Terms of Service or the documents they incorporate by reference or your violation of any law or the rights of a third-party.

Private Health Funds
If you have private health insurance, you are responsible for liaising directly with your private health fund to determine if you are eligible for private health benefits in respect of the services you receive from Nurture and Nourish Lactation, Ashleigh Foy.
Services
Antenatal Education
Information provided by Nurture and Nourish Lactation is general in nature and is not tailored for any person's specific health needs.
Participation in antenatal education with Nurture and Nourish Lactation does not in any way replace or substitute appropriate and regular antenatal check-ups and medical care by your treating practitioner.
You must have a treating practitioner providing antenatal care and be enrolled to give birth with a healthcare provider (private midwife/ general practitioner/ hospital setting) in order to participate.
